Service Terms and Conditions

Daily Guided Rides operated in South Africa, including Cape Town and the Winelands.

1. Booking and Payment
A booking is confirmed when we have received your full payment.
Payments are non-refundable unless the tour is cancelled by us or in case of cancellation policy below. 
Failure to pay on time may result in cancellation.

2. Pricing
All prices are quoted in South African Rands (ZAR). 
Tour inclusions and exclusions are clearly stated in your booking confirmation.

3. Cancellations
By You: Cancellations must be made in writing. Refund policy:
- More than 10 days before: Full refund
- 5-10 days: 50% refund
- Less than 5 days: no refund

By Us: We may cancel due to low bookings, safety concerns, or events beyond our control (eg. Weather conditions) 
In such cases, you will receive a full refund or alternative date.

4. Insurance
All participants must hold comprehensive travel insurance or South African medical aid covering medical emergencies, trip cancellation, and third-party liability. Proof may be required before departure.

5. Health and Fitness
Cycling tours require a reasonable level of fitness. You are responsible for assessing your ability and must disclose relevant medical conditions. We reserve the right to refuse participation if safety is at risk.

6. Equipment
Hired bikes are supplied in good condition. You are responsible for them during the hire period.
If bringing your own bike, you are responsible for transport, maintenance, and insurance.
You must bring suitable cycling helmet (no helmet, no ride)

7. Waiver and Assumption of Risk
By participating, you acknowledge that cycling involves inherent risks including accidents, equipment failure, weather, road conditions, and natural hazards. You participate voluntarily and accept full responsibility for your actions and safety.

You agree to indemnify African Cycle Tours Ltd and its representatives against any claims or losses arising from your participation, except where caused by proven negligence.

8. Liability
We take reasonable steps to ensure safety but accept no liability for injury, loss, or damage arising from circumstances beyond our control. Total liability shall not exceed the total amount paid for the booking.

9. Complaints
If you have a complaint, inform the guide immediately. If unresolved, email us within 5 days. 
We aim to respond within 24 hours.

10. Consumer Protection
African Cycle Tours Ltd complies with the Consumer Rights Act 2015 and Consumer Protection from Unfair Trading Regulations 2008. Payments made via Stripe are processed securely under UK law.

11. Itinerary and Changes
We may adjust itineraries due to local conditions or safety concerns. 
Equivalent alternatives will be provided where possible.

12. Governing Law
These Terms are governed by English law. Disputes shall fall under the jurisdiction of the courts of England and Wales.
